Under New Jersey law, when you file a dog bite lawsuit, you need only prove that the victim was lawfully on the premises when the dog attack occurred and that the dog attack caused injury to the plaintiff. If an attack occurs somewhere other than on the dog owner's property, such as a public park or street, you need only prove that the dog in question is the same dog that attacked and caused your injuries. The defendant (owner or keeper) of the dangerous dog is strictly liable for all injuries and damages suffered by the plaintiff. Prior knowledge of whether or not it was a vicious dog or an overly aggressive breed does not matter.
